(made under rule 26 and rule 28 of the Haryana Civil Services (Assured Career Progression) Rules, 2008)

Subject: Improving further the General ACP pay structure of Haryana Government employees.

Whereas the State Government notified Haryana Civil Services (Assured Career Progression) Rules, 2008 vide notification No. G.S.R.-45/Const./Art. 309/08, dated 30th December, 2008 for providing financial upgradation to its employees in the absence of opportunity of functional promotion.

2. The objective of these rules was to provide two kinds of Assured Career Progression Schemes namely:-

1) Cadre Specific Assured Career Progression Scheme for certain categories of employees/ cadres.

ii) General Assured Career Progression Scheme for all other group A, B, C and D employees of Haryana Government who are not covered under scheme (i).

3. The General Assured Career Progression Scheme provides opportunities of financial upgradatlon to the employees on completion of 10, 20 and 30 years of services, if they have not got promotion during previous 10 years of service.

4. On the persistent demand of Haryana Government employees, the matter has been further considered by the Government at length and after careful consideration, the Government has decided to modify the general ACP scheme as under:-

i) The term of 10, 20 and 30 years of service for grant of 1st, 2nd and 3rd ACP respectively has been changed to 8, 16 and 24 years. Accordingly, Rule 7 and all other relevant provisions of these rules will be deemed to have been modified to this extent.

ii). ACP grade pay indicated in Column No. 4, 5 and , against the pre-revised & revised functional pay scale indicated in Column No. 2 & 3 of Sr. No. 1, 2, 4, 5, 6, 7, 8, 9, 10 & 11 of Schedule I, Part-II of these rules have been modified as under:-

Sub:- Grant of Dearness Allowance to State Government employees.

The Governor is pleased to order that the existing rate of Dearness Allowance payable to the State Government employees, drawing pay in Rajasthan Civil Services (Revised Pay) Rules, 2008, under Finance Department Order No. F.6(1 )FD(Rules)/2008 dated 21-09-2013 shall be revised from 90% to 100% with effect from 01-01-2014.

The term ‘Pay’ for the purpose of calculation of Dearness Allowance shall be the Basic Pay i.e. sum of pay in running pay band and grade pay drawn and shall not include any other type(s) of pay like Special Pay or Personal Pay, etc.

The payment on account of Dearness Allowance involving fraction of 50 paisa and above may be rounded off to the next higher rupee and the fraction of less than 50 paisa may be ignored.

The amount of increase in Dearness Allowance for the period from 01-01-2014 to 28-02-2014 shall be credited to the General Provident Fund Account of the respective employees and cash payment shall be admissible from 01-03-2014 i.e. salary for the month of March, 2014 payable on 01-04-2014.

The arrear of DA from 01-01-2014 to 28-02-2014 to the employees recruited to the Civil Services on or after 01-01-2004 and who are governed by Contributory Pension Scheme, shall be paid in cash.

The Governor is pleased to order that the existing rate of Dearness Allowance payable, to the work-charged employees governed under the Rajasthan Public Works Department (B&R) including Gardens, Irrigation, Land Development (Programme), PHED, CAD Chambal Department, Kota, Ayurved and Forest Department Work charged Employees Service Rules, 1964 or under corresponding provisions of standing orders, where such employees are governed by specific standing orders and are drawing pay in the running pay bands and grade pays prescribed under the Rajasthan Work-charged Employees (Revised Pay) Rules, 2008 shall be revised from 90% to 100% with effect from 01-01-2014.

Grant of Dearness Relief to State Government Pensioners.

ORDER

Subject: - Grant of Dearness Relief to State Government Pensioners.

The Governor is pleased to order that the existing rate of Dearness Relief sanctioned vide Finance Department Order of even number dated 21-09-2013 to the State Government Pensioners who are in receipt of superannuation, retiring, invalid, compensation, family and extra ordinary pension etc. shall be revised from 90% to 100% with effect from 01-01-2014.

For the purpose of this order :-

(I) Pension/Family Pension in the case of pre-01-01-2006 retirees and where Family Pension was sanctioned prior to 01-01-2006, means the Consolidated Pension or Consolidated Family Pension, as the case may be, effective from 01-01-2006 in terms of Finance Department Memorandum No. F.12(3)FD(Rules)/ 2008 dated 12-09-2008 as amended vide FD Memorandum dated 06-04-2013.

(ii) In the case of pensioners who retire from service on or after 01-01-2006 or where family pension is sanctioned for the first time on or after 01-01-2006, Pension/Family Pension means the Basic Pension/Basic Family Pension, as the case may be, in terms of Finance Department Notification No. F.12(3)FD(Rules)/ 2008 dated 12-09-2008 as amended vide FD Notification dated 06-04-2013.

(iii) Dearness Relief will, also be admissible on the additional quantum of pension / family pension allowed to the pensioners who have attained the age of 80 years and above.

(iv) Payment of Dearness Relief involving a fraction of a rupee shall be rounded off to the next higher rupee.

(v) Other provisions governing grant of dearness relief to pensioners’ such as regulation of dearness relief during employment/re-employment, regulation of dearness relief where more than one pension is drawn etc., will remain unchanged.

(vi) This order shall also be applicable in case of Pensioners/Family Pensioners who are in receipt of provisional pension.

(vii) This order shall not be applicable in case of Old Age Pensions, Political Pensions or any other kind of similar pensions, which are not related to the service rendered under Government.

(viii) Dearness Relief at revised rates as above would also be admissible to pensioners who retired/retire from service of Panchayat Samiti or Zila Parishad and whose Pension Payment Orders have been issued by the Director, Local Fund Audit Department or Director, Pension and Pensioners’ Welfare Department, Rajasthan, Jaipur.

Subject: - Clarification regarding grant of grade pay on promotional post.

Sir/ Madam,

I am directed to invite a reference to this Department Notification No Fin(PR)B(7)-64/2010-Loose dated 24/09/2012 vide which Himachal Pradesh Civil Services (Category /Post wise Revised Pay) Rules, 2012 have been notified. Under these rules pay structure of certain categories of employees has been revised w.e.f. 01/10/2012 or thereafter as per schedule appended to these rules.

References have been received from various quarters seeking clarification as to what grade pay is to be allowed in the cases where the grade pay of feeder post is higher to the grade pay at entry level of the higher/ promotional post.

The matter has been considered by the Government and it is clarified that in all such cases where the grade pay at entry level of the promotional post has become lower than the grade pay attached to feeder post, the higher grade pay being drawn in the feeder post shall be protected.

These instructions will be applicable with immediate effect, prospectively.

Allowances – Hill Allowance and Winter Allowance to employees working in places declared as Hill Stations – Enhancement – Orders – Issued.

Allowances – Hill Allowance and Winter Allowance to employees working in places declared as Hill Stations – Enhancement – Orders – Issued. 

Read: 

G.O.Ms.No.236, Finance (PC) Department, Dated 01.06.2009. 

ORDER: 

 In the Government Order read above, among others, orders has been issued enhancing the Hill Allowance and Winter Allowance as per the recommendation of the Official Committee, 2009. 

 2. The Hon’ble Chief Minister in the Collectors’ Conference held on 13.12.2013, among others, has made the following announcement in respect of the Hill / Winter Allowance 

i) Sl.No. 79: Hill Allowance for Government employees will be increased to Rs.1,500/- per month. 

ii) Sl.No. 80: Winter Allowance for Government employees will be increased to Rs. 500/- per month. 

3. Based on the above announcement, Government issues the following orders:- 

(I) HILL ALLOWANCE: 

The existing rate of Hill Allowance shall be retained at the same rate of 20% of pay subject to the enhancement of maximum ceiling limit of Rs. 900/- to Rs.1500/- per month. 

(II) WINTER ALLOWANCE: 

 The revised rate of Winter Allowance shall be as below: 

1. Those working in the places at 1000 metres to 1,499 metres above M.S.L. ---- 5% of basic pay including grade pay subject to a maximum of Rs.400/- p.m. 

2. Those working in the places at 1,500/- metres above M.S.L. ------  10% of basic pay including grade pay subject to a maximum of Rs.500/- p.m. 

4. The above orders will take effect from the date of issue of this order.

No. 2/26/2013-lPenslon.- In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Haryana hereby makes the following rules to further amend the Punjab Civil Services Rules, Volume-II, in their application to the State of Haryana, namely: -

(1) These rules may be called the Punjab Civil Services Volume-II (Haryana Amendment) Rules, 2014.

(2) They shall come into force with effect from 24th September, 2012.

2. In the Punjab Civil Services Rules Volume-II, In Appendix-I, in Family Pension Scheme, 1964, in para 10,-

(i) for the sign “. “existing at the end, the sign “: “shall be substituted ; and

(ii) after para 10, the following proviso shall be added, namely:-

“Provided that widows/widowers of such Government employees as are governed by this scheme shall be allowed to draw dual family pension i.e. one from civil side and another from military side.

Central Government should pay the dearness allowance of state government employees as well – Mamata Banerjee
W.B Government Employees would be able to avail themselves of cashless hospitalisation facility of up to Rs 1 lakh

Centre should come forward and pay the dearness allowance of state government employees as well, West Bengal Chief Minister Mamata Banerjee demanded today.

“Whenever the Centre announces DA, state government employees should be given the same on a par (with central government employees).

“They (Centre) give it (to central government employees) before elections. Will others (state government employees) suck their thumbs?” Banerjee asked.

“We want the Centre to pay the DA for (state government) employees,” Banerjee said. She added that paying DA cost Rs 6,900 crore to the state exchequer.

“How will we be able to afford it when the central government is taking all the money from us?” she asked.

Speaking at a convention of state government employees organised under the banner of the Paschimbanga Sarkari Karmachari Federation, Banerjee said the matter had also been taken up with the Finance Commission.

She reiterated her charge that the Union government had stopped funds for various central schemes like Pradhan Mantri Gram Sadak Yojana and the Mahatma Gandhi National Rural Employment Guarantee Scheme.

“There should be a tax for those who lie,” she said.

She also added that restructuring should be done for the interest on loans taken from the Centre by the previous Left Front government.

“Why should we pay for the faults of CPI(M)?” she asked. Criticising the Left-affiliated coordination committee of state government employees, Banerjee said the body should now be dismantled as it did no work.

“They have no work besides criticising others. They are shameless. They did no work for the last 34 years and now, too, are not working,” she said while adding that such employees were holding up various files.

She, meanwhile, announced that housing loans would be restarted for the welfare of employees. Rs 100 crore has been earmarked for the same under a scheme entitled ‘Akanksha’.

A health scheme has also been extended for another two years under which government employees would be able to avail themselves of cashless hospitalisation facility of up to Rs 1 lakh.

“We have added new hospitals to the list and also (expanded the disease cover),” Banerjee said.

The undersigned is directed to say that Government in Finance Department have extended Revised Assured Career Progression Scheme for the State Government employees vide Finance Department Resolution No.3560/F., dt.6.2.2013 and issued clarification in respect of the Driver vide Memo No.16400/F., dt.2.5.2013. Thereafter, the doubts have been raised and clarifications have been sought from different quarters regarding implementation of RACP Scheme in respect of other State Government employees.

After careful consideration of the various provisions of RACP Scheme contained in FD Resolution No.3560/F., dt.6.2.2013, it has been decided to issue the following clarifications for guidance of all concerned.

Amendments in the West Bengal Service Rules, Part - I

No.175-F(P), dated 9th January, 2014.- In exercise of the power conferred by the proviso to article 309 of the Constitution of India, the Governor is pleased hereby to make the following amendments in the West Bengal Services Rules, Part-I, as subsequently amended (hereinafter referred to as the said rules) :-

Amendments

In the said rules:-

(I) in rule 5,-

(a) after clause (10 ), insert the following clauses:-

“(10A) Deputation means any appointment made by transfer on a temporary basis against a sanctioned post outside the regular line and in the public interest.

(10B) Detailment means utilization of service of an employee in any job for a temporary period in the public interest under any Department or office of the Government or in any Company. Corporation, Undertaking and Statutory Body etc.. which is wholly or substantially owned or controlled by the State Government or by any body which is funded by the State Government.”;

(2) in CHAPTER XII:-

(a) for the heading. substitute the following heading:-

“FOREIGN SERVICE, DEPUTATION AND DETAILMENT”;

(b) for the words “foreign service”, wherever they occur, subsiitute the words "foreign service or on deputation.”;

(c) rule 97 shall be renumbered as sub-rule (1) of that rule,-

(i) in sub-rule (I) so renumbered,-

(A) for the words “No Government employee shall be transferred whether within or outside India, against his will.” substitute the following words:-

“Any Government employee may, in the interest of public service, be transferred to foreign service or on deputation within or outside India,”:

(B) for the proviso, substitute the following proviso:“

Provided that in case of transfer to foreign service or on deputation outside India, the consent of the Government employee shall be necessary to his transfer to such foreign service or on such deputation outside India.”;

(ii) after sub-rule (1), insert the following sub-rule:-

“(2) A Government employee may, if the State Government may deem fit and proper to do so to meet the exigency for any job and for optimum utilization of manpower as well as to realize full potential of such Government employee, be detailed in any other Department or office under the Government or in any Company, Corporation, Undertakings, Statutory Government or by any body which is funded by the State Government, for a period not exceeding six months without following the provisions contained in this Chapter or elsewhere in these rules and during such detailment, the terms and conditions of service including drawal of pay and allowances, promotion, sanction of leave, disciplinary control etc., shall remain with the parent cadre controlling authority or Department or office, as the case may be and shall not be any way altered to the disadvantage of
such Government employee and the period of detailment of such Government employee may be extended beyond the period of six months, if the concerned cadre controlling authority, or Department or the office or the Company, Corporation. Undertaking, Statutory Body etc. as above, feels it necessary or at the option of the concerned Government employee.”;

(iii) in Note.- (1). add the following proviso:-

“Provided that in case of a transfer to foreign service or on deputation or by detailment to any Department or office of the Government or in any Company, Corporation, Undertaking, Statutory Body etc., which is wholly or substantially owned or controlled by the State Government or by any body which is funded by the State Government, within the State, of any Government employee, no deputation allowance will be admissible to such Government employee for such transfer.”;

(iv) in Note- (2), for words “without previous consultation with the Finance Department.”. substitute the following words, figure and brackets:-

“in consultation with the Finance Department either prior to issue of the order of transfer or post facto. In case of detailment as mentioned in sub-rule (2), no such consultation will be necessary.”;

(v) in Note.-(4), for the words “after prior consultation”, substitute the word “in”: (3) Omit sub-rule (a) of rule 98.

I am directed to refer to this office letter No. 2/53/ 2009-1Pension dated 26.4.2010 vide which clarification for entitlement of a person to receive family pension on the date of death of the employee or pensioner was issued.

2. Sometime past the issue has been received in Finance Department for further clarification in r/o family pension to widowed/divorced daughter. After due consideration, in reference to Rule 14 of Haryana Civil Services (Revised Pension) Rules, 2009 and earlier clarification issued vide No. 2/53/2009-1 Pension dated 26.4.2010, it is further clarified that the family pension will be payable to widowed/divorced daughters if she fulfils all the eligibility conditions at the time of death of the Government servant or his/her spouse, whichever is later provided she is still eligible for family pension when her turn comes. The family pension will continue only till she remarries or starts earning her livelihood equal to or more than the sum of minimum family pension and dearness relief thereon.

The position is iliustrated through an example. Shri X, a Pensioner, died in 1985. He was survived by his wife, Smt Y, a son Shri Z and a daughter, Kumal E the daughter being the younger. Kumari E married in 1989 and got widowed in 1995. Smt. Y died in 2000. Thereafter, Shri Z (son) was getting family pension being disabled and died in 2002. Thereafter, the family pension was stopped as. Kuniari E was not eligible for it at that time. She applied for family pension on the basis of Haryana Civil Services (Revised Pension) Rules, 2009. Since she was a widow and had no independent source of Income at the time of death of her mother (family pensioner) and on the date her turn came, she may be granted family pension.

3. These instructions may please be brought to the notice of all concerned for necessary action.

Sub: Grant of Dearness Relief to State Government Pensioners /Family Pensioners with effect from January 01, 2014.

In continuation of this Department Memo No.08-F (Pen) dated 02.01.2013 sanctioning instalment of relief to the State Government Pensioners/Family Pensioners with effect from 01.01.2013 onwards, the undersigned is directed to state that the Governor is pleased to decide that the State Government Pensioners/Family Pensioners shall draw Dearness Relief @ 58% of basic pension/basic family pension with effect from January 01, 2014 onwards in supersession of the rates mentioned in the Order dated 02.01.2013 as mentioned above.

 ORDER:
In the Government Order first read above, a new Contributory Pension Scheme based on defined contribution has been introduced for all employees who are recruited on or after 01.04.2003. In the Government Order second read above, Government inter-alia ordered that the Accountant General will maintain the accounts for the Contributory Pension Scheme as in the case of General Provident Fund and the Index Number to the employees who join the Contributory Pension Scheme will be allotted by the Accountant General on receipt of application from the Head of Department / Heads of Offices in the prescribed form.

It has been decided to revise the rate of Dearness Allowance admissible to the State Government Employees with effect from January 01, 2014 vide Finance Department’s Memo No. 8840-F(P2) dated 16.12.13, copy of which is enclosed for ready reference.

Tamil Nadu govt. announces Pongal bonus for its employees, pensioners

Tamil Nadu Government on sunday announced  Pongal bonus for its employees and pensioners, which would cost it a sum of Rs 308.28 crore.

Chief Minister J. Jayalalithaa announced Rs 3,000 for Group C and Group D officials and teachers.

Those under Group A and Group B, anganwadi workers, ICDS employees, village assistants and certain temporary staff will be provided Rs 1,000, she said in a statement.
